THE 2024 TOOLS4PAINTING PURDY BACKPACK PRIZE GIVEAWAYS CONTEST OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.

CONTEST:

The 2024 TOOLS4PAINTING Purdy Backpack Prize Giveaway (the “Contest”) shall commence at 9:00 am ET on August 12, 2024 and shall end at 11:59 pm ET on August 31, 2024 (the “Contest Period”). The sponsor of the Contest is TOOLS4PAINTING, located at 1310 Union Street Spartanburg, South Carolina 29302 (“Sponsor”). In the event of a conflict between the entry instructions and these Contest Official Rules (the “Official Rules”), these Official Rules shall control. The clock located on the computer system used by the Sponsor shall govern with respect to the commencement and end times for the Contest Period, and the time and date of the receipt of each entry. This Contest is subject to federal, state, and local laws and regulations and void where prohibited by law. For purposes of these Official Rules, a person who enters the Contest is referred to as a “Participant”.

ELIGIBILITY:

This Contest is open to all United States residents who are 18 years of age or older and the age of majority in the applicable jurisdiction as of the date of entry. Employees of Sponsors and each of their employees, subsidiaries, affiliates, suppliers, partners, advertising and promotion agencies, and directors (collectively the “Employees”), as well as members of an Employees' immediate family and/or those living in the same household of Employees are ineligible to participate in the Contest. Proof of eligibility will be required when claiming any Prize. Participants may be asked to provide more information for Sponsors to confirm the identity and eligibility of a Participant. Sponsors make the final determination at their sole discretion as to who is eligible to participate and/or win the Contest. Participants agree to abide by these Official Rules and by the decisions of Sponsors, which are final and binding in all respects.

HOW TO ENTER: To enter the Contest, a Participant must follow the TOOLS4PAINTING Facebook or Instagram account they are entering on AND do at least one of the following during the Contest Period: 1) like the Contest post 2) comment on the Contest post 3) tag another user in the Contest post’s comments 4) share the Contest post. Each eligible Participant will receive entries into the Contest by each of the actions taken on the post per social media platform:

Sponsors reserve the right to extend the Contest Period at the Sponsors’ sole discretion. A Participant must fulfill all Contest requirements to be eligible to win the Prize. Any entry that is incomplete, fraudulent, or does not adhere to the Official Rules is void and will not be given further consideration or be otherwise eligible for the Prize. By entering the Contest, Participants certify that they followed and complied with these Official Rules.

AGREEMENT TO OFFICIAL RULES:

By entering this Contest, Participants have affirmatively reviewed, accepted, and agreed to abide by these Official Rules and Sponsors’ decisions, which are fully and unconditionally binding in all respects. Sponsors reserve the right to refuse, withdraw, or disqualify any Participant at any time at the Sponsors’ sole discretion. Sponsors reserve the right to cancel or amend the Contest and these Official Rules without notice. By entering this Contest, Participants represent and warrant that they are eligible to participate based on the eligibility requirements set forth in the Official Rules. Participants also agree to accept the decisions of the Sponsors as final and binding as it relates to this Contest.

PRIZE:

There will be one winner of the Contest (“Winner”), who will win the prize (the “Prize”). The value of the Prize is approximately $631.28 USD. Actual/appraised value may differ at time of Prize award.

The specifics of the Prize shall be solely determined by Sponsors at their sole discretion.

PRIZE RESTRICTIONS:

No cash or other Prize substitutions shall be permitted except Sponsors may substitute any portion of the Prize with a prize of equal or greater value at their sole discretion. The Prize is nontransferable. WINNER AGREES TO ACCEPT ALL ASPECTS OF THE PRIZE “AS IS” AND SPONSORS MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AND EXPRESSLY DISCLAIM ANY WARRANTY OF TITLE, MERCHANTIBILITY, OR FITNESS FOR A PARTICULAR PURPOSE. ALL TAXES, FEES, COSTS AND EXPENSES OF WHATEVER NATURE, INCLUDING WITHOUT LIMITATION SALES TAXES, PERMITS, AND INSURANCE SHALL BE THE SOLE RESPONSIBILITY OF THE WINNER, AS WELL AS ALL CURRENT AND FUTURE TAXES, COSTS, FEES, INSURANCE, AND EXPENSES RELATING TO ANY ASPECT OF THE PRIZE. WINNER IS REQUIRED TO PROVIDE SPONSORS WITH A SIGNED W9 FORM TO BE ELIGIBLE FOR THE PRIZE. All federal, state, and/or local taxes, and all other expenses not specifically mentioned shall be the sole responsibility of Winner. No substitution of the Prize or transfer/assignment of the Prize to others or request for the cash equivalent by Winner is permitted.

ODDS:

The odds of winning depend on the number of eligible Entries entered into the Contest.

One Winner will be selected by Sponsors at their sole discretion. Winner will be randomly selected from all eligible Entries on September 9, 2024 from approximately 8:00 am ET to 4:30 pm ET. Winners will be announced immediately following the selection. Winner must respond to TOOLS4PAINTING’s direct message within 48 hours on the platform they entered to accept the Prize. Sponsors shall have no liability for Winner’s failure to respond or otherwise learn that they won the Contest. If the Winner cannot be contacted, is ineligible, or fails to immediately claim the Prize, the Prize may be forfeited and an alternate Winner selected. Receipt by Winner of the Prize offered in this Contest is conditioned upon compliance with any and all federal, state, and local laws and regulations, and these Official Rules. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (at Sponsors’ sole discretion) WILL RESULT IN WINNER’S DISQUALIFICATION AS A WINNER OF THE CONTEST, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

PUBLICITY:

Except where prohibited, participation in the Contest constitutes the consent of each Participant to Sponsors’ and their respective agents’ understanding and agreement that Sponsors, anyone acting on behalf of Sponsors, and Sponsors’ licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, the Participant’s name, portrait, picture, voice, likeness, image, statements about the Contest, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. Participants agree to defend, indemnify and hold harmless the Sponsors against any claims that arise out of a claimed infringement of intellectual property rights.

TERMS & CONDITIONS:

Sponsors reserve the right, in their sole discretion, to cancel, terminate, modify or suspend the Contest should virus, bug, non-authorized human intervention, fraud, or other cause beyond Sponsors’ control corrupt or affect the administration, security, fairness, or proper conduct of the Contest. In such case, Sponsors may select the Winner from all eligible Tickets received prior to and/or after (if appropriate) the action taken by Sponsors. Sponsors reserve the right, in their sole discretion, to disqualify any Participant who tampers or attempts to tamper with the entry process or the operation of the Contest or violates these terms and conditions or the Official Rules. Sponsors have the right, in their sole discretion, to void Tickets for any reason in order to maintain the integrity of the Contest. Any attempt by a Participant to undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such attempt be made, Sponsors reserve the right to seek damages to the fullest extent permitted by law.

GENERAL CONDITIONS AND LIMITATION OF LIABILITY:

By participating in this Contest and/or accepting a Prize, Participants warrant and represent that they agree to be bound by these Official Rules (including all eligibility requirements) and the decisions of the Sponsors and their agents, which shall be final and binding in all respects. Participants on behalf of themselves and their heirs, assignees, executors, and administrators agree to release and hold harmless Sponsors and their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any and all liability, illness, injury, including but not limited to personal injury and bodily injury (including without limitation wrongful death or disability), death, loss, litigation, claim, or property damage, or loss or damage of any other kind that may occur, directly or indirectly, whether caused by negligence or not, from: (i) a Participant’s participation in the Contest and/or their acceptance, possession, use, or misuse of any Prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Contest; (v) electronic or human error in the administration of the Contest or the processing of entries; and (vi) any Contest-related activity. If, in the exclusive judgment of the Sponsors, the Contest becomes compromised in any way, Sponsors reserve the right to withdraw the Contest offer and select a Winner from all eligible Tickets received prior to the act that compromised the Contest. Any attempt to deliberately damage or subvert the Contest or its operation is unlawful and subject to legal action by the Sponsors or their agents. Should the Contest be terminated prior to the last day of the Contest Period, notice will be provided via email and on the following website: www.lancasterco.com.

DISPUTES:

THIS Contest IS GOVERNED BY THE LAWS OF SOUTH CAROLINA WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, Participant agrees that: (i) any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, or any prize awarded, or the determination of Winner, shall be resolved individually, without resort to any form of class action, exclusively before a court located in South Carolina; (ii) to the fullest extent permitted by law, waives any right to a jury trial in any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prize awarded, or the determination of Winner; and (iii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred but in no event attorney’s fees. Further, in any such dispute, under no circumstances shall the Participants be permitted to obtain awards for, and hereby waive all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than Participants’ actual out-of-pocket expenses (i.e. costs associated with entering this Contest). Participants further waive all rights to have damages multiplied or increased.

PRIVACY POLICY:

Information submitted with an Entry is subject to the Privacy Policy stated on the TOOLS4PAINTING Website at https://www.tools4painting.com/privacy-policy-cookie-restriction-mode.

WINNER LIST:

Winner’s name, username, profile, likeness, and company may be posted on the Sponsors’ respective websites and shared via email. Participants may also request Winner’s name via mail by sending a self-addressed, stamped envelope and a request for the list to: TOOLS4PAINTING, Prize Giveaway, 1310 Union Street Spartanburg, South Carolina 29302, no later than December 1, 2024.
